Delayed and cancelled flights
At DAT, punctuality is a top priority, and we are committed to ensuring our flights depart on time. However, despite our best efforts, delays and irregularities may sometimes occur.
In such cases, passengers are protected under Regulation (EC) No. 261/2004, which establishes your rights in the event of delays, cancellations, or denied boarding.

What Is a Delay?
A delayed flight occurs when an aircraft departs or arrives later than its originally scheduled time. Delays can result from various factors, such as weather conditions, technical issues, operational challenges, or restrictions imposed by air traffic control.
Your Rights If Your Flight Is Delayed
If your flight is delayed by 2 hours or more, you may be entitled to certain forms of assistance. Additionally, if the delay extends to 3 hours or more, you could be eligible for compensation under Regulation (EC) No. 261/2004.
Assistance in Case of Delay:
Under certain conditions, the airline is required to provide the following assistance:
- Meals and refreshments that are reasonable and proportional to the delay.
- Hotel accommodation if an overnight stay is necessary.
- Transportation between the airport and your place of accommodation.
- Two free communications, such as phone calls, emails, or faxes.
Re-routing or Refund:
In case of long delays (5 hours and more), depending on your preferences and the situation, you may have the following options:
- Re-routing: Travel on an alternative flight to your final destination at no additional cost, subject to seat availability.
- Rebooking: Travel on a later date that suits you, subject to available capacity.
- Refund: A full refund of the unused ticket, including any return journey, if you no longer wish to travel.
Compensation:
You may be entitled to financial compensation unless an exception applies. The compensation amounts are as follows:
- EUR 250 for flights up to 1,500 kilometres.
- EUR 400 for flights between 1,500 and 3,500 kilometres.
- EUR 600 for flights over 3,500 kilometres.
Exceptions to Compensation for Delays:
You may not be entitled to compensation in the following cases (this list is not exhaustive, and other factors could affect your eligibility):
- Extraordinary Circumstances: The delay was caused by events beyond the airline’s control, such as severe weather, air traffic control decisions, or unforeseen technical issues.
- Failure to Meet Airline Requirements: You did not check in by the deadline specified by the airline or arrive at the boarding gate on time.
What Is a Cancellation?
A cancellation occurs when a flight is officially canceled by the airline, meaning the flight will not operate as originally scheduled. This can happen due to various reasons, such as unforeseen technical issues, strikes, severe weather conditions, airspace restrictions, or other extraordinary circumstances.
Cancellation Due to Extraordinary Circumstances
Extraordinary circumstances refer to events that could not have been avoided even with all reasonable measures taken. Examples include:
- Severe weather conditions or the impact of adverse weather on previous flights.
- Urgent technical issues that directly affect flight safety.
- Strikes or other labor disputes impacting operations.
- Airspace restrictions imposed by Air Traffic Control (ATC).
- Unforeseeable crew illnesses.
- Security risks or unforeseen safety concerns.
- Other extraordinary events, such as natural disasters, acts of terrorism, or political instability.
If your flight is cancelled due to extraordinary circumstances, the airline is not required to provide monetary compensation. However, DAT will offer:
- Re-routing: Travel on an alternative DAT flight to your final destination at no additional cost, subject to seat availability.
- Rebooking: An option to change your journey to a later departure, subject to available capacity.
- Refund: If the purpose of your trip is no longer valid, you are entitled to request a refund for the unused ticket, including any return journey.
Cancellation Due to Circumstances Within DAT’s Control
Cancellations that result from circumstances within the airline’s control may include:
- Operational adjustments within the airline’s control.
- Predictable technical issues.
- Staffing shortages that should have been reasonably anticipated.
If your flight is cancelled for these reasons, you may be entitled to:
- Re-routing or Refund:
- Travel on an alternative DAT flight to your final destination at no additional cost, subject to seat availability.
- A full refund of the unused ticket and any return journey if you choose not to proceed with your travel plans.
- Assistance:
- Meals and refreshments proportional to the waiting time.
- Hotel accommodation and transportation to/from the hotel if an overnight stay is necessary.
- Two free telephone calls, emails, or faxes.
- Compensation: You may be entitled to financial compensation as follows:
- EUR 250 for flights up to 1,500 kilometres.
- EUR 400 for flights between 1,500 and 3,500 kilometres.
- EUR 600 for flights over 3,500 kilometres.
Exceptions to Compensation:
You may not be entitled to compensation in the following cases (this list is not exhaustive, and other factors could affect your eligibility):
- Timely Notification: You were informed of the cancellation:
- 14 days or more before the scheduled departure.
- 7 to 14 days before departure and offered an alternative flight that departs no more than 2 hours earlier and arrives no more than 4 hours later.
- Less than 7 days before departure and offered an alternative flight that departs no more than 1 hour earlier and arrives no more than 2 hours later.
- Extraordinary Circumstances: The cancellation was caused by events beyond the airline’s control.
- Failure to Meet Check-In Requirements: You did not check in or present yourself at the boarding gate by the deadline specified by the airline.
- Voluntary Cancellation: You voluntarily opted for a refund or re-routing and agreed to forego compensation.
- Missed Alternative Flight: You failed to accept or board an alternative flight offered by the airline.
- Timely Notification: You were informed of the cancellation:
- Non-Compliance with Travel Documentation: You did not provide the necessary travel documents, such as a valid passport, visa, or other required identification.
What Is Denied Boarding?
Denied boarding occurs when a passenger is not allowed to board a flight, even though they have:
- A valid ticket and confirmed reservation.
- Checked in on time as specified by the airline.
- Presented themselves at the boarding gate within the required timeframe.
Your Rights If Denied Boarding
If you are denied boarding against your will, you may be entitled to assistance, re-routing, or a refund, as outlined in Regulation (EC) No. 261/2004.
Assistance and Rights:

- Transportation between the airport and the place of accommodation.

- Rebooking: Travel at a later date that suits you, subject to seat availability.
- Refund: A full refund of the unused ticket, including any return journey, if you no longer wish to travel.

You may also be entitled to compensation unless an exception applies. The compensation amounts are as follows:
- EUR 250 for flights up to 1,500 kilometres.
- EUR 400 for flights between 1,500 and 3,500 kilometres.
- EUR 600 for flights over 3,500 kilometres.
Exceptions to Compensation for Denied Boarding:
You may not be entitled to compensation in the following cases (this list is not exhaustive, and other factors could affect your eligibility):
- Voluntary Denied Boarding: You voluntarily gave up your seat in exchange for agreed benefits, such as compensation, re-routing, or other arrangements offered by the airline.
- Reasonable Grounds: You were denied boarding for safety, security, health, or inadequate travel documentation, including:
- Failure to provide a valid passport, visa, or other required travel documents.
- Non-compliance with safety or security regulations.
- Failure to Meet Airline Requirements: You did not check in by the deadline specified by the airline or arrive at the boarding gate on time.
- Overbooking with Passenger Agreement: You accepted an alternative solution offered by the airline, such as re-routing, without further claims for compensation.
